Si compraste un coche entre febrero de 2006 y julio de 2013 tenemos una buena noticia que darte, pues el Tribunal Supremo en su sentencia 1878/2021 ha ratificado las multas interpuestas en el 2015 por la CNMC (Comisión Nacional de los Mercados y la Competencia) y esto significa que vas a poder reclamar todo el dinero que te cobraron de más por la compra de tu coche.
Lo que desde hace poco se conoce como el «Cartel de Coches» consistió en una serie de practicas ilícitas que los fabricantes de coches llevaron a cabo sobre el uso de información secreta, futura y estratégica. Las marcas compartieron información que adulteró la competencia haciendo que se incrementase el precio final de los coches en un 15%. Esto llegó a afectar alrededor de 10 millones de vehículos en España, más o menos un 90% de la cuota del mercado, y se calcula que la indemnización media por afectado podría ir desde los 2.500 a los 9.000 €, más los intereses que se hayan generado desde que se compró el vehículo.

La Comisión Nacional de los Mercados y la Competencia ha interpuesto desde hace tiempo varias sanciones a las mismas pero ha sido este mismo año 2021 cuando el Tribunal Supremo las ha ratificado, por lo que es bastante seguro que se asiente una doctrina general a nivel nacional adoptada a partir de ahora por todos los juzgados de España que falle a favor de todos los afectados por el Cartel de Coches.
La documentación requerida para poder reclamar el dinero que pagaste de más es la siguiente:
- Factura de compra
- Ficha técnica del coche
- Contratos firmados en la compra- venta
En cuanto a los plazos estipulados o al tiempo que puede se puede tardar en recuperar el dinero:
Lo primero es que, una vez hayas localizado la documentación necesaria para iniciar los trámites de reclamación, tu abogado realice una reclamación extrajudicial a la marca para interrumpir el plazo de suscripción.
La marca tendrá un plazo de dos meses legales para responder a dicha reclamación. En torno a los seis meses, un año, tendríamos una sentencia. Estos plazos siempre pueden variar dependiendo del punto de España donde nos encontremos.
