Empezamos felices el día dando a nuestro cliente la gran noticia de que hemos conseguido la nulidad de su contrato con la entidad Cofidis a un 24,51% TAE, ya que el juez ha considerado que es abusivo y usurario, otorgándole la devolución de toda cantidad percibida en beneficio de la misma, es decir, de todos los intereses cobrados desde el inicio del préstamo, cifra que asciende a casi 16.000 euros.
El cliente llevaba arrastrando una línea de crédito con esta entidad desde 1992, las primeras cantidades prestadas habían sido en pesetas. Por su situación personal siempre tuvo que ir tirando de pequeños préstamos para ir haciendo frente a los gastos de su vida diaria. Cada mes que se retrasaba un solo día en el pago, los intereses aumentaban y la propia entidad le había incluido un seguro de protección de pagos, del que ni siquiera era consciente, desde hacía varios años, por lo que de lo que pagaba todos los meses no amortizaba apenas nada.
Este tipo de entidades es muy propicia a incluir estos seguros como forma de inflar la factura, pero realmente hemos visto muy pocos casos en los que a un cliente le ha llegado a cubrir en el momento en que no han podido pagar un solo mes.
“Pagar el recibo de Cofidis era para mi como pagar la luz, algo que sabía que estaba ahí todos los meses, ya eran muchos años y nunca se acababa, veía que al final iban a heredar esta deuda mis hijos” – nos decía.
Se puso en contacto con la plataforma en septiembre del 2020 tras enterarse de que el Tribunal Supremo había condenado a las entidades crediticias a bajar los intereses y a devolver todos los ya cobrados por usura ya que sabía que era la única forma de deshacerse de esa deuda eterna y poco más de año después su larga historia con Cofidis ha terminado, y de la mejor forma posible. El juez, en su sentencia ha considerado que el interés del 24,51% TAE aplicado es abusivo y desproporcionado a las circunstancias, produciéndose además un desequilibrio entre los derechos y las obligaciones de las partes.
Durante el procedimiento de reclamación, la entidad intentó dificultar cada paso que dimos, retrasar el proceso lo máximo posible, como suele ser, pero en este caso, el juzgado tramitó bastante rápido y hemos obtenido un fallo favorable en un tiempo más que razonable.
